Terms of Service

1. Beta Service
The Service is currently in public beta. It is provided on an "as is" basis without warranty of any kind. During the beta period: (a) features may be added, changed, or removed without prior notice; (b) the Service may contain bugs, errors, or interruptions; (c) data formats and APIs may change in ways that are not backward-compatible; (d) we are not liable for any data loss, downtime, or damages arising from beta-specific issues. By using the Service during the beta period, you acknowledge and accept these conditions. We will announce the end of the beta period via email and through the Service.
2. Acceptance of Terms
By accessing or using the Widgets PRO platform ("Service"), operated by Widgets PRO B.V. ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree, you may not use the Service.
3. Description of Service
Widgets PRO is a cross-platform dashboard platform that enables users to create, manage, and deploy real-time dashboards across web, mobile, TV, automotive, and VR devices. The Service includes the Widgets PRO web application, mobile applications, APIs, and related documentation.
4. Account Registration
To use certain features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use. You must be at least 16 years old to create an account.
5. Subscriptions and Payments
Paid plans are billed in advance on a monthly or annual basis. All fees are quoted in euros (EUR) and are non-refundable except as required by law or as described in our refund policy. We may change pricing with 30 days' notice. You authorize us to charge your payment method on file for recurring subscription fees. If payment fails, we may suspend access to paid features after a 7-day grace period.
6. User Content and Data
You retain ownership of all data and content you upload to the Service ("User Content"). By using the Service, you grant us a limited license to process, store, and display your User Content solely to provide and improve the Service. You are responsible for ensuring that your User Content does not violate any applicable laws or third-party rights. We do not claim ownership of your dashboards, widgets, or data.
7. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the Service; © interfere with or disrupt the Service infrastructure; (d) reverse-engineer, decompile, or disassemble any part of the Service; (e) use the Service to transmit malware or harmful code; (f) resell or redistribute the Service without authorization; (g) use automated means to scrape or extract data from the Service beyond what our API permits.
8. API Usage
Access to the Widgets PRO API is subject to rate limits and usage quotas based on your subscription plan. We reserve the right to throttle or suspend API access in cases of abuse or excessive use that degrades the Service for other users. API keys are confidential and must not be shared publicly.
9. Intellectual Property
The Service, including its design, code, trademarks, and documentation, is owned by Widgets PRO B.V. and protected by intellectual property laws. Nothing in these Terms grants you rights to our trademarks, logos, or brand assets. Feedback you provide about the Service may be used by us without obligation to you.
10. Third-Party Integrations
The Service may integrate with third-party services (e.g., data sources via MCP, authentication providers). Your use of third-party services is governed by their respective terms. We are not responsible for the availability, accuracy, or practices of third-party services.
11. Service Availability and SLA
We strive to maintain 99.9% uptime for paid plans. Scheduled maintenance windows will be communicated in advance. We are not liable for downtime caused by force majeure events, third-party service outages, or circumstances beyond our reasonable control. Business plan customers are covered by a separate Service Level Agreement.
12. Termination
You may cancel your account at any time through your account settings. We may suspend or terminate your account if you violate these Terms, with notice where practicable. Upon termination, your right to use the Service ceases immediately. We will make your data available for export for 30 days following termination, after which it may be permanently deleted.
13. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
14. Limitation of Liability
To the maximum extent permitted by law, Widgets PRO B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
15. Governing Law
These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of Amsterdam, the Netherlands. Notwithstanding the foregoing, either party may seek injunctive relief in any court of competent jurisdiction.
16. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
